How does it work?
Under the Australian Law, you can only apply for a divorce after both partners have been separated for a period of at least one year. The Family Law Act established a no-fault divorce system in 1976, which meant no partner is to be blamed for the divorce; the only ground here is that the marriage is broken down to a point that there is no going back.
If there are children involved under the age of 18, the divorce is only granted by the Australian Court if all the required arrangements have been made for the welfare of the child/children.
You can also apply for a Joint Application for Divorce if you and your partner agree mutually. However, if one partner does not agree to the divorce, you can still apply for it on your own. But it will be compulsory for you to serve the application for divorce on your partner before the hearing.
If the other partner disagrees to the divorce, the Australian Court will grant the divorce, as long as the partners have been separated for more than a year and the welfare of the child/children has been taken care of. At times, you will have to submit a proof of separation; also it is sometimes possible to apply for a divorce if the partners have been living in separation under the same establishment.
If you are looking to settle for child arrangements and/or financial and property issues, it is not necessary to apply for a divorce. In cases like these, there is no need to wait for a year to deal with these issues because divorce is an independent and separate Court case.
Once the divorce order has been granted at the hearing, it does not become final until a month and a day after the hearing. Hence, it is recommended that you postpone your plans to involve yourself into any other decision like remarrying until a date has been fixed by the Court for the divorce to be final.
The Australian Court can also issue divorce to parties that no longer reside in Australia. As long as any one partner is an Australian citizen by birth or lived in Australia for at least 12 months before filing for a divorce.
